AGENCY DISCLOSURE

It's The Law in North Carolina...

To provide a written explanation, to be signed by buyers and sellers, explaining to the client the role that the broker plays in a transaction. The purpose of disclosure is to explain whether the broker represents the buyer or seller or a dual agent ( representing both) or a subagent (an agent of the sellers broker). This allows the customer to understand to which party the broker owes loyalty.

  • Example: When first meeting with a Realtor, he/she are the seller's agent, their loyalty is to the sellers regardless of whether the Realtor or his/her company is the Listing Agent. The agent represents the sellers in any of the properties they show you. Any confidential information you pass on to the Agent they pass on to the seller.

Buyers Agent defines the responsibilities of the Agent to the Buyer as:

  • Promote your interest
  • be loyal to you
  • follow your lawful instructions
  • provide you with all material facts that could influence your decisions
  • use realsonal skill, care and diligence and account for all monies they handle for you.
  • Once you have agreed for the firm and its agents to be your buyers agent, they may not give any confidential information zbout you to sellers or their agents without your permission so long as they represent you. But, unitl you make this agreement with your buyer's agent, you should avoid telling the agent anything you would not want a seller to know.
